Do zoznamu sa zapisuje:<\/p>\n<p>a\/ u\u00a0fyzick\u00fdch os\u00f4b \u2013 meno, priezvisko, trval\u00fd pobyt a\u00a0d\u00e1tum narodenia<\/p>\n<p>b\/ u\u00a0pr\u00e1vnickej osoby \u2013 n\u00e1zov, s\u00eddlo a\u00a0identifika\u010dn\u00e9 \u010d\u00edslo pr\u00e1vnickej osoby.<\/p>\n<p>Zapisuje sa aj pomer \u00fa\u010dasti \u010dlena spolo\u010denstva na v\u00fdkone pr\u00e1v a\u00a0povinnost\u00ed, d\u00e1tum a\u00a0pr\u00e1vny d\u00f4vod vzniku \u010dlenstva v spolo\u010denstve,\u00a0d\u00e1tum z\u00e1pisu do zoznamu ako aj v\u0161etky zmeny evidovan\u00fdch skuto\u010dnost\u00ed, vr\u00e1tane zmien v\u00a0\u010dlenstve spolo\u010denstva.<\/p>\n<p>Spolo\u010denstvo v zmysle z\u00e1kona do 31.marca v\u00a0ka\u017edom roku za\u0161le Okresn\u00e9mu \u00faradu, zoznam \u010dlenov aktualizovan\u00fd k\u00a031.decembru predch\u00e1dzaj\u00faceho roka.<\/p>\n<p>4\/ \u010clen spolo\u010denstva a\u00a0fond m\u00e1 pr\u00e1vo nahliadnu\u0165 do zoznamu a\u00a0\u017eiada\u0165 a\u00a0robi\u0165 si z\u00a0neho v\u00fdpisy<\/p>\n<p>5\/ \u010clenovia spolo\u010denstva a\u00a0fond s\u00fa povinn\u00ed v\u0161etky zmeny evidovan\u00fdch skuto\u010dnost\u00ed nahl\u00e1si\u0165 spolo\u010denstvu prostredn\u00edctvom v\u00fdboru do dvoch mesiacov odo d\u0148a ich vzniku.<\/p>\n<p>6\/ Pomer \u00fa\u010dasti \u010dlena spolo\u010denstva na v\u00fdkone pr\u00e1v a povinnost\u00ed vypl\u00fdvaj\u00facich z \u010dlenstva v\u00a0spolo\u010denstve je vyjadren\u00fd podielom v\u00fdmery a\u00a0umiestnen\u00edm nehnute\u013enosti patriacej \u010dlenovi spolo\u010denstva na celkovej v\u00fdmere spolo\u010dne obhospodarovan\u00fdch nehnute\u013enost\u00ed v\u0161etk\u00fdch \u010dlenov spolo\u010denstva.<\/p>\n<p>7\/ Ak tretia osoba tvrd\u00ed, \u017ee je spoluvlastn\u00edkom spolo\u010dnej nehnute\u013enosti alebo spolo\u010dne obhospodarovanej nehnute\u013enosti a\u00a0toto pr\u00e1vo nem\u00f4\u017ee hodnoverne preuk\u00e1za\u0165 pr\u00edslu\u0161nou listinou alebo in\u00fdm sp\u00f4sobom, spolo\u010denstvo odk\u00e1\u017ee t\u00fato tretiu osobu na konanie pred pr\u00edslu\u0161n\u00fdm s\u00fadom.<\/p>\n<p>Na pr\u00e1va a\u00a0povinnosti \u010dlenov spolo\u010denstva sa vz\u0165ahuj\u00fa ustanovenia Ob\u010dianskeho z\u00e1konn\u00edka ak, z\u00e1kon o\u00a0pozemkov\u00fdch spolo\u010denstv\u00e1ch neustanovuje inak.<\/p>\n<p>&nbsp;<\/p>\n<h3 style=\"text-align: center;\"><span style=\"color: #99cc00;\">\u010cl. V\u00fd\u0161ku odmeny ur\u010d\u00ed zhroma\u017edenie.<\/p>\n<p>&nbsp;<\/p>\n<h3 style=\"text-align: center;\"><span style=\"color: #99cc00;\">\u010cl. V\u00fdbor najmenej 25 dn\u00ed pred term\u00ednom zasadnutia zhroma\u017edenia uverejn\u00ed ozn\u00e1menie o\u00a0zasadnut\u00ed zhroma\u017edenia v\u00a0m\u00e9diu s\u00a0celo\u0161t\u00e1tnou p\u00f4sobnos\u0165ou, na\u00a0svojom webovom s\u00eddle alebo na webovej str\u00e1nke Obce Horn\u00e1 Ves a na obvyklom mieste uverejnenia, ktor\u00fdm je \u00faradn\u00e1 tabu\u013ea Obce\u00a0Horn\u00e1 Ves. Ak vlastn\u00edk podielu spolo\u010dnej nehnute\u013enosti prev\u00e1dza svoj podiel pod\u013ea \u00a7 9 ods. 7 alebo ak fond prev\u00e1dza podiel vo vlastn\u00edctve \u0161t\u00e1tu pod\u013ea \u00a7 11 ods. 2, v\u00fdbor to uvedie v\u00a0programe zasadnutia zhroma\u017edenia.<\/p>\n<p>2. V\u00fdbor je povinn\u00fd zvola\u0165 zasadnutie zhroma\u017edenia, ak ho o\u00a0to p\u00edsomne po\u017eiadaj\u00fa \u010dlenovia spolo\u010denstva, ktor\u00fdch hlasy predstavuj\u00fa aspo\u0148 tretinu hlasov \u010dlenov spolo\u010denstva, v\u00a0term\u00edne, ktor\u00fd navrhn\u00fa \u010dlenovia spolo\u010denstva. Ak v\u00fdbor nezvol\u00e1 zasadnutie zhroma\u017edenia alebo ak ho zvol\u00e1 v\u00a0inom term\u00edne, na ktorom sa nedohodol s\u00a0\u010dlenmi spolo\u010denstva, ktor\u00ed ho o\u00a0zvolanie zasadnutia zhroma\u017edenia po\u017eiadali, zasadnutie zhroma\u017edenia zvol\u00e1 na n\u00e1vrh splnomocnen\u00e9ho z\u00e1stupcu \u010dlenov spolo\u010denstva Okresn\u00fd \u00farad v Prievidzi, pozemkov\u00fd a\u00a0lesn\u00fd odbor. Okresn\u00fd \u00farad, pozemkov\u00fd a\u00a0lesn\u00fd odbor m\u00e1 povinnosti v\u00fdboru pod\u013ea odseku 1<\/p>\n<p>3. Prehlasovan\u00ed \u010dlenovia spolo\u010denstva maj\u00fa pr\u00e1vo obr\u00e1ti\u0165 sa na s\u00fad, aby rozhodol o\u00a0neplatnosti rozhodnutia zhroma\u017edenia.<\/p>\n<p>(7 Zhroma\u017edenie m\u00f4\u017ee zasada\u0165 formou \u010diastkov\u00fdch sch\u00f4dz\u00ed, ak o\u00a0tom rozhodne v\u00fdbor, pri\u010dom \u010diastkov\u00e9 sch\u00f4dze s\u00fa s\u00fa\u010das\u0165ou jedn\u00e9ho zasadnutia zhroma\u017edenia. Ka\u017ed\u00fd \u010dlen spolo\u010denstva m\u00f4\u017ee hlasova\u0165 len na jednej z\u00a0\u010diastkov\u00fdch sch\u00f4dz\u00ed. Pri rozhodovan\u00ed sa s\u010d\u00edtavaj\u00fa hlasy odovzdan\u00e9 na v\u0161etk\u00fdch \u010diastkov\u00fdch sch\u00f4dzach. V\u00fdbor kon\u00e1 za \u010dlenov spolo\u010denstva okrem \u010dlenov spolo\u010denstva uveden\u00fdch v\u00a0z\u00e1kone o\u00a0pozemkov\u00fdch spolo\u010denstv\u00e1ch pod\u013ea \u00a7 10 ods.\u00a01 a\u00a02 pred s\u00fadmi a\u00a0org\u00e1nmi verejnej spr\u00e1vy vo veciach podnikania na spolo\u010dnej nehnute\u013enosti, alebo ich m\u00f4\u017ee zastupova\u0165 vo veciach nadob\u00fadania vlastn\u00edctva k\u00a0sporn\u00fdm nehnute\u013enostiam, ktor\u00e9 sa maj\u00fa sta\u0165 s\u00fa\u010das\u0165ou spolo\u010dnej nehnute\u013enosti.<\/p>\n<p>3. V\u00fdbor m\u00e1 7 \u010dlenov. Rokovanie v\u00fdboru organizuje a riadi predseda spolo\u010denstva. Predsedu spolo\u010denstva vol\u00ed v\u00fdbor zo svojich \u010dlenov.<\/p>\n<p>4. V\u00fdbor zodpoved\u00e1 za svoju \u010dinnos\u0165 zhroma\u017edeniu. Ak zo zmluvy o\u00a0spolo\u010denstve nevypl\u00fdva nie\u010do in\u00e9, za v\u00fdbor kon\u00e1 navonok predseda spolo\u010denstva. Ak je na pr\u00e1vny \u00fakon, ktor\u00fd rob\u00ed v\u00fdbor, predp\u00edsan\u00e1 p\u00edsomn\u00e1 forma, je potrebn\u00fd podpis predsedu a\u00a0aspo\u0148 jedn\u00e9ho \u010fal\u0161ieho \u010dlena v\u00fdboru.<\/p>\n<p>5. Predsedu spolo\u010denstva v\u00a0\u010dase jeho nepr\u00edtomnosti zastupuje poveren\u00fd \u010dlen v\u00fdboru zap\u00edsan\u00fd v\u00a0registri.<\/p>\n<p>6. \u010clenovi v\u00fdboru mo\u017eno prizna\u0165 za v\u00fdkon jeho funkcie odmenu. V\u00fdbor predklad\u00e1 zhroma\u017edeniu spolu s\u00a0ro\u010dnou \u00fa\u010dtovnou uz\u00e1vierkou aj n\u00e1vrh rozdelenia zisku alebo sp\u00f4sobu \u00fahrady straty .<\/p>\n<p>&nbsp;<\/p>\n<h3 style=\"text-align: center;\"><span style=\"color: #99cc00;\">\u010cl. Dozorn\u00e1 rada zodpoved\u00e1 za v\u00fdkon svojej \u010dinnosti zhroma\u017edeniu.<\/p>\n<p>(2\u00a0 Dozorn\u00e1 rada m\u00e1 troch \u010dlenov. Jeden \u010dlen dozornej rady, nemus\u00ed by\u0165 \u010dlenom spolo\u010denstva. \u010clenstvo v\u00a0dozornej rade je nezlu\u010dite\u013en\u00e9 s \u010dlenstvom vo v\u00fdbore.<\/p>\n<p>(3 Na \u010dele dozornej rady stoj\u00ed predseda dozornej rady. Pri prevode podielu spolo\u010dnej nehnute\u013enosti nesmie vznikn\u00fa\u0165 spoluvlastn\u00edcky podiel na spolo\u010dnej nehnute\u013enosti, ktor\u00e9mu zodpoved\u00e1 v\u00fdmera men\u0161ia ako 2000 m2<\/p>\n<p>(4 Nadob\u00fadate\u013e vlastn\u00edckeho pr\u00e1va k\u00a0podielu spolo\u010dnej nehnute\u013enosti sa prevodom alebo prechodom vlastn\u00edckeho pr\u00e1va st\u00e1va \u010dlenom spolo\u010denstva a\u00a0vstupuje do pr\u00e1v a\u00a0povinnost\u00ed \u010dlena spolo\u010denstva v\u00a0rozsahu nadob\u00fadan\u00e9ho podielu a\u00a0je povinn\u00fd do dvoch mesiacov odo d\u0148a nadobudnutia vlastn\u00edckeho pr\u00e1va prist\u00fapi\u0165 k\u00a0zmluve o spolo\u010denstve.<\/p>\n<p>(5 Pomer \u00fa\u010dasti \u010dlenov spolo\u010denstva na v\u00fdkone pr\u00e1v a\u00a0povinnost\u00ed vypl\u00fdvaj\u00facich z\u00a0\u010dlenstva v\u00a0spolo\u010denstve je vyjadren\u00fd podielmi na spolo\u010dnej nehnute\u013enosti.<\/p>\n<p>(6 Ak je spolo\u010dn\u00e1 nehnute\u013enos\u0165 zap\u00edsan\u00e1 v\u00a0katastri nehnute\u013enost\u00ed na viacer\u00fdch listoch vlastn\u00edctva a pomer \u00fa\u010dasti \u010dlenov spolo\u010denstva na v\u00fdkone pr\u00e1v a\u00a0povinnost\u00ed vypl\u00fdvaj\u00facich z\u00a0\u010dlenstva v\u00a0spolo\u010denstve nemo\u017eno ur\u010di\u0165 pod\u013ea odseku 4, mo\u017eno ho ur\u010di\u0165 dohodou \u010dlenov spolo\u010denstva alebo rozhodnut\u00edm zhroma\u017edenia.<\/p>\n<p>(7 Na prevod podielu spolo\u010dnej nehnute\u013enosti medzi \u010dlenmi spolo\u010denstva sa nevz\u0165ahuje v\u0161eobecn\u00e9 ustanovenie o\u00a0predkupnom pr\u00e1ve,\/ \u00a7 140 Ob\u010dianskeho z\u00e1konn\u00edka\/ [2]) ak nejde o\u00a0prevod pod\u013ea \u00a7 11 ods.2 z\u00e1kona. Ak vlastn\u00edk podielu spolo\u010dnej nehnute\u013enosti prev\u00e1dza svoj spoluvlastn\u00edcky podiel, mus\u00ed ho pon\u00faknu\u0165 na predaj ostatn\u00fdm vlastn\u00edkom podielov spolo\u010dnej nehnute\u013enosti \u00a0alebo spolo\u010dne obhospodarovanej nehnute\u013enosti prostredn\u00edctvom v\u00fdboru. Ak o\u00a0podiel neprejavia z\u00e1ujem ostatn\u00ed vlastn\u00edci podielov, m\u00f4\u017ee ho preda\u0165 tretej osobe.<\/p>\n<p>(8 Prevod vlastn\u00edckeho pr\u00e1va k\u00a0podielu na spolo\u010dnej nehnute\u013enosti len na niektor\u00fdch pozemkoch patriacich do spolo\u010dnej nehnute\u013enosti je zak\u00e1zan\u00fd.<\/p>\n<p>(9 Prevod alebo prechod vlastn\u00edckeho pr\u00e1va k podielu na spolo\u010dnej nehnute\u013enosti na spolo\u010denstvo je zak\u00e1zan\u00fd.<\/p>\n<p>(10 Zmluvu o\u00a0prevode vlastn\u00edctva k\u00a0oddelenej \u010dasti spolo\u010dnej nehnute\u013enosti mo\u017eno za rovnak\u00fdch podmienok uzavrie\u0165 so v\u0161etk\u00fdmi vlastn\u00edkmi spolo\u010dnej nehnute\u013enosti aj jednotlivo na viacer\u00fdch listin\u00e1ch; t\u00fdm nie s\u00fa dotknut\u00e9 ustanovenia \u00a7 30 ods.5 p\u00edsm. a.\/ z\u00e1kona NR SR \u010d. 165\/1995 Z.z v\u00a0znen\u00ed neskor\u0161\u00edch predpisov.<\/p>\n<p>(11 V\u00fdnos z\u00a0predaja oddelenej \u010dasti spolo\u010dnej nehnute\u013enosti je pr\u00edjmom vlastn\u00edkov spolo\u010dnej nehnute\u013enosti, ktor\u00ed prist\u00fapili k zmluve o prevode vlastn\u00edctva k oddelenej \u010dasti spolo\u010dnej nehnute\u013enosti. Ak vlastn\u00edcke podiely na spolo\u010dnej nehnute\u013enosti spravuje alebo s\u00a0nimi naklad\u00e1 fond, v\u00fdnos z predaja oddelenej \u010dasti spolo\u010dnej nehnute\u013enosti je pr\u00edjmom fondu pod\u013ea ve\u013ekosti podielov spolo\u010dnej nehnute\u013enosti, ktor\u00e9 fond spravuje alebo s\u00a0ktor\u00fdmi naklad\u00e1.\/ \u00a7 18 ods.5 z\u00e1kona NR SR \u010d. 180\/1995 Z. z.[3]) Vlastn\u00edk podielov spolo\u010dnej nehnute\u013enosti, s\u00a0ktor\u00fdmi fond naklad\u00e1, alebo\u00a0jeho pr\u00e1vny n\u00e1stupca m\u00f4\u017ee p\u00edsomne u\u00a0fondu uplatni\u0165 svoje pr\u00e1vo na vydanie v\u00fdnosu z\u00a0predaja v\u00a0lehote desiatich rokov odo d\u0148a povolenia vkladu vlastn\u00edckeho pr\u00e1va, ak predlo\u017e\u00ed doklady, ktor\u00fdmi preuk\u00e1\u017ee svoj n\u00e1rok, inak jeho pr\u00e1vo zanik\u00e1.<\/p>\n<p>(12 Odseky 10 a 11 sa primerane vz\u0165ahuj\u00fa aj na zriadenie vecn\u00e9ho bremena zmluvou a na obmedzenie vlastn\u00edckeho pr\u00e1va vyvlastnen\u00edm sa primerane vz\u0165ahuj\u00fa odseky 10 a\u00a011 tohto \u010dl\u00e1nku.<\/p>\n<p>(13 Vlastn\u00edci spolo\u010dnej nehnute\u013enosti za \u00fa\u010delom \u010dinnost\u00ed spolo\u010denstva uveden\u00fdch v\u00a0\u010dl. II, m\u00f4\u017eu na seba prev\u00e1dza\u0165 alebo si in\u00e9 pozemky fyzick\u00fdch a\u00a0pr\u00e1vnick\u00fdch os\u00f4b prenaj\u00edma\u0165. Pr\u00edstupov\u00e9 konania a\u00a0\u010fal\u0161ie \u00fakony s\u00a0t\u00fdmto spojen\u00e9 vykon\u00e1va v\u00fdbor spolo\u010denstva.<\/p>\n<p>(14 Vlastn\u00edci spolo\u010dnej nehnute\u013enosti m\u00f4\u017eu spolo\u010dn\u00fa nehnute\u013enos\u0165 alebo jej \u010das\u0165 prenaja\u0165. Fond vykon\u00e1va pr\u00e1va \u010dlena spolo\u010denstva, len ak zhroma\u017edenie rozhoduje pod\u013ea \u010dl. V. ods. 4 p\u00edsm. a), b), d) h) a\u00a0i. tejto zmluvy.<\/p>\n<p>4. Vlastn\u00edci podielov spolo\u010dnej nehnute\u013enosti maj\u00fa k\u00a0podielom spolo\u010dnej nehnute\u013enosti, ktor\u00e9 fond spravuje pod\u013ea ods. 1. predkupn\u00e9 pr\u00e1vo. Ak \u017eiaden z\u00a0vlastn\u00edkov spolo\u010dnej nehnute\u013enosti neprejav\u00ed v\u00a0ur\u010denej lehote z\u00e1ujem o\u00a0k\u00fapu podielov spolo\u010dnej nehnute\u013enosti, fond m\u00f4\u017ee vyhl\u00e1si\u0165 verejn\u00fa obchodn\u00fa s\u00fa\u0165a\u017e za rovnak\u00fdch podmienok .<\/p>\n<p>5. Fond v\u00a0konan\u00ed pred s\u00fadom, alebo pred org\u00e1nom verejnej spr\u00e1vy kon\u00e1 v\u00a0mene vlastn\u00edkov podielov spolo\u010dnej nehnute\u013enosti pod\u013ea odsekov 1 a\u00a02 vo veciach podielov spolo\u010dnej nehnute\u013enosti, a\u00a0to aj vtedy, ak vlastn\u00edcke pr\u00e1vo t\u00fdchto vlastn\u00edkov je sporn\u00e9.<\/p>\n<p>&nbsp;<\/p>\n<h3 style=\"text-align: center;\"><span style=\"color: #99cc00;\">\u010cl.
